王姓大貨車司機去年1月行經台南市安南區停等紅燈時，因未繫安全帶加上滿臉通紅被員警攔查進行酒測，酒測值達0.19毫克，因超過標準值挨罰3萬3000元，吊扣駕駛執照24個月，王男認為吊扣駕照處罰過重，對台南市交通局提起行政訴訟，台南地院判王男敗訴，但撤銷吊扣駕照處分，由交通局另為適法處理。

判決書指出，王男供稱知道酒後駕車是錯誤行為，但當日只飲用了一些保力達飲料，也沒行車不穩及肇事，王男表示他是低收入戶，需要扶養父母及兒女，若吊扣駕照2年將無法維持生計，聲請撤銷裁決書中吊扣駕駛執照的處分。

法官審酌，王男訴請撤銷吊扣駕照處分，雖無理由，但裁決書就吊扣期間裁處超過最低法定罰部分，難認已盡合義務性裁量，故撤銷這部分裁罰，由交通局另為妥適裁罰。
