找盧秀燕客串「女兵」逆轉免罰20萬

2019年聯利媒體TVBS歡樂台戲劇「女兵日記女兵報到」,劇中男女主角到台中花博拍攝婚紗照巧遇台中市長盧秀燕,盧當時為了行銷花博客串,國家通訊傳播委員會(NCC)事後認定該情節為置入性行銷,裁罰聯利媒體20萬元。聯利對此提告一審敗訴並提上訴,二審法院認定,盧與該節目無對價關係,並非為置入性行銷,逆轉撤銷20萬元裁罰確定。

判決指出,2019年3月8日播出的「女兵日記女兵報到」節目因劇中男女主角前往台中花博展區拍攝婚紗照,並巧遇台中市長盧秀燕,NCC認定該情節為置入性行銷,刻意影響節目內容編輯,且聯利媒體並未依照規定明顯揭露置入者名稱或商標,違反衛星廣播電視法,裁罰20萬元。

聯利媒體事後對此提起行政訴訟,一審遭台北地方法院駁回後提出上訴。台北高等行政法院二審認定,並沒有聯利媒體與盧秀燕互有對價關係事證,且NCC處分主旨或事實均未詳述或探討何以證明兩者間具有有償或對價關係,NCC有違職權調查主義及處罰法定主義,且未證明雙方對價關係存在,裁罰有違誤,故廢棄一審判決,撤銷20萬元裁罰定讞。

The horn antenna is a broadband passive device, shaped like a pyramid horn, referred to as a TEM antenna, which guides the beam of radio waves at a precise frequency.
